How is a Industrial Designs registered in other States?  

 

1. DIRECTLY

 Country by country, by filing the relevant application in each of the countries in which you want to register the industrial design, claiming priority by right of a first filing in Spain (to not renounce the novelty or unique nature). 2. By means of an INTERNATIONAL DESIGN

Through this procedure, regulated under the The Hague Agreement (Geneva Act), protection may be obtained in numerous countries by filing a single application with the World Intellectual Property Organisation (WIPO) (Geneva), with the registration having the same effect as if the application had been filed in each of the designated countries. Each country can grant or refuse protection.

If the application is filed with the SPTO, a forwarding fee (international registration fee before the SPTO) will be applied.

The duration of this registration is five years, and it can be renewed up to a maximum number of years which varies by State.

3. By means of a COMMUNITY DESIGN

 Establishes the possibility of using a single application, which can be filed either with the SPTO or the European Union Intellectual Property Office (EUIPO) (Alicante) at the discretion of the applicant, to obtain protection in the 27 member states of the European Union (EU).

The duration of this registration is 5 years, and it can be renewed for up to 25 years.
